synopsis
Part of the Constitution: That Delicate Balance series, Constitution: That Delicate Balance - Criminal Justice and a Defendant's Right to a Fair Trial explores the intersection of the defendant's right to a fair trial with the public's right to expect safety on their streets and in their homes. The panel of constitutional experts, politicians, and journalists pursue hypothetical arguments in an attempt to find the point at which the public's right to expect safety infringes on the defendant's right to a fair trial. The Exclusionary Rule is given particular consideration.
